An employment contract is a unique agreement. In setting out the rights, duties and obligations of both employer and employee, it is more than an agreement to provide work for remuneration. And it exists even if the parties have not executed a written document.
 
It is essential that employment contracts be drafted clearly, unambiguously and in compliance with the law. If not, an employer may be precluded from relying on the contract to limit its liability after the employment relationship comes to an end.
